Terms Of Service for use of my internet domains:

In this bilateral online contract, you the user are 'the subscriber' and buyer and we are the 'service provider' and seller. This is the external master contract, which can have a complex substructure of agreements between you and other users of these domains.

1. Offer

   Cibernética Americana provides two basic kinds of service via these domains, priced and public. Public services are free and are available to the anonymous public without subscription. Priced services are subscribed by specific individuals as entitled users of said services.
   
   The subscriber and provider agree to be bound soley by the terms of this agreement and explicitly acknowledge that neither party will have any recourse to its terms by virtue of the laws of any particular national, provincial, or local jurisdiction whatsoever.

2. Consideration

   No consideration is applicable to non-priced services, i.e. there is no offer as regards this content nor are these services in any other than the public (i.e. not the legal) sense. Non-monetized value exchanges are fully contained within the internal subagreements as detailed features of the provided service(s) and have no bearing on this external agreement.
   
   The consideration received by the subscriber in exchange for the service price fee is the provision, as is, of these services or service for some defined time period. The subscriber explictly acknowledges by accepting this agreement that said service(s) are provided with the same limitations common to traditional software licensing, i.e. without assumption of any liablity whatsover on the part of the service provider, including but not limited to any guarantee of fitness for a specific purpose or for merchantability, even though the service provided is an on-line service and not a software package.
   
   Subscribers positively acknowledge by this agreement that any priced service is an equal or greater exchange for the value of the fee charged and that they have verified this by use of the non-priced service or other independent means.

3. Acceptance

   Subscribers signify their acceptance of the terms of this agreement for use of the service by execution of transaction(s) paying for priced service or implicitly by continued use in the case of non-priced service. Subscribers affirm by accepting this master agreement that by observation of non-priced and or priced service provided here and by a complete understanding of these simply stated terms that they make an informed, irrevocable, consent to said terms.
   
   The Service Provider agrees to accept the subscriber as a user of the paid service during the agreed upon term OR refund the complete purchase price in full except as impacted by third party party service party failures such as computer manufacturers, hosting or telecommunications providers, third party software providers, and/or other Subscribers.

This agreement is strictly between the creator of these web domains and their users. Any third party relations, such as between individual subscribers or subscriber groups and/or internet service providers or developers of third party software are outside it's scope. In general we always pass any third partys licensing or other terms thru directly to subscribers or we do not use the package or service if we cannot.

Agreements concluded here between subscribers are explicitly excluded from this master agreement except in so far as the provision of the automated service supporting such agreements is concerned. Users implicitly agree by continued use to abide by these and subsidiary rules established for these domains or quit same.
